From my years of experience I have discovered a very simple yet efficient way to protect your assets in one of the last truly bullet proof structures available: The Individual Retirement Account or IRA. IRAs are one of the only asset protection structures that survived the recent bankruptcy "reforms". IRAs also provide tax defered savings since you only pay taxes on the income when you withdraw the funds. All income earned on funds in an IRA are tax free.

However, IRAs have limitations and restrictions.

There are many types of investments that are either prohibited by federal rules, or practically impossible due to the refusal of most IRA Custodians to cooperate. For instance, investments in collectibles such as artwork, antiques, collectible coins, wine, etc. are prohibited. Investments in insurance vehicles, foreign stocks and foreign real property are also off limits. And other investments such as bullion and real estate in the USA, although not prohibited, are exceedingly difficult. If you wanted to invest in precious metals (not collectible coins), you could, but you would not be able to keep possession yourself. Real Estate located in the US is permited but finding a trustee who will hold the property on behalf of the IRA is difficult.

Thanks to an important ruling by a federal tax court, this is no longer the case. It is now possible for you to "rescue" the funds in your IRA by establishing a specially structured Limited Liability Company which will be wholly owned by your IRA. This company will be owned by your IRA, but will be controlled by you. You will be able to invest the funds in this Company as you see fit, subject to basic rules of business ethics and management.
